Terms of Use
Alpha Growth Partners, LLC, DBA alphaScaling
Effective date: October 19, 2026
These Terms of Use (the "Terms") govern your access to and use of alphascaling.co and any other site, landing page, form, or application we operate (together, the "Sites"), and the services we provide through them. They are a binding agreement between you and Alpha Growth Partners, LLC, doing business as alphaScaling ("alphaScaling," "we," "us," or "our").
PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SITES, OR BY SUBMITTING A FORM, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SITES.
1. Definitions
- Client means a business that has signed a written service agreement with us.
- Service Agreement means the written agreement, order form, or statement of work between alphaScaling and a Client.
- Homeowner means an individual who responds to advertising or a landing page we operate on behalf of a Client and asks to be connected with a contractor.
- Visitor means anyone who browses the Sites without becoming a Client.
- Growth Assessment means the introductory call we offer to businesses to evaluate whether our services are a fit.
- Qualified Consultation means a consultation that has been requested by a Homeowner and scheduled through our system, and that meets the qualification criteria set out in the Client's Service Agreement.
- Growth Credits means the units a Client purchases or earns under a Service Agreement, each representing one Qualified Consultation.
- Content means all text, graphics, logos, images, software, and other materials on the Sites.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Sites or our services. If you use the Sites on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. Our Services
alphaScaling builds and manages client acquisition systems for businesses, including paid advertising management, lead capture, AI-assisted follow-up, appointment setting, nurturing sequences, and related growth services. The specific deliverables, fees, and scope for each Client are set out in that Client's Service Agreement.
We may change, suspend, or discontinue any part of the Sites at any time. We are not liable to you or any third party for doing so.
4. No Guarantee of Results
Marketing outcomes depend on many factors outside our control, including market conditions, pricing, advertising platform policies, seasonality, and the Client's own sales process. We do not guarantee any specific revenue, lead volume, close rate, or return on advertising spend. Any figures, case studies, or examples on the Sites are illustrations and are not promises of future results.
5. Client Responsibilities
If you are a Client, you agree to:
- Follow up promptly and professionally with every Homeowner connected to you, and attend scheduled consultations
- Comply with all laws that apply to your contact with Homeowners, including telemarketing, text messaging, and email laws such as the Telephone Consumer Protection Act and the CAN-SPAM Act, and honor opt-out requests immediately
- Hold the licenses, insurance, and permits your business needs to perform the work you sell
- Provide accurate business information, service areas, and project criteria, and tell us promptly when they change
- Not misrepresent alphaScaling, or use Homeowner information for any purpose other than the consultation the Homeowner requested
- Be solely responsible for the quality, pricing, and delivery of your own work, and for any agreement you make with a Homeowner
alphaScaling is not a party to any agreement between a Client and a Homeowner and is not responsible for the work a Client performs or fails to perform.
6. Growth Credits and Consultation Disputes
Growth Credits are tied to the Client's account, are not transferable, and have no cash value except as stated in the Service Agreement. Packages, pricing, and expiration terms are set out in the Service Agreement.
If a Client believes a consultation was not a Qualified Consultation, the Client may submit a dispute to support@alphascaling.co within 72 hours after the scheduled consultation time. The dispute must identify the consultation and include supporting evidence, such as call recordings, message screenshots, or CRM records.
We may approve a dispute for reasons such as:
- The Homeowner submitted a duplicate request
- The property is outside the Client's agreed service area
- The project type does not match the Client's agreed criteria
- The person is not the owner of the property or authorized to decide on the project
- The contact information provided is invalid and no other valid contact method could be found
- The project is below the minimum project size stated in the Service Agreement
We review disputes within two business days after receiving the supporting evidence. If a dispute is approved, we credit the Client's Growth Credits balance for the affected consultation. Credits are the sole remedy for a disputed consultation.
The following are not grounds for a dispute: a Client's decision not to pursue the project, a disagreement over price, a Homeowner's choice to hire another contractor, a Client's close rate, or a Client's failure to follow up or attend the consultation. Where a Homeowner did not attend, we may ask for evidence of the Client's reasonable attempts to reschedule before considering a credit.
If these Terms and a Service Agreement conflict on any point in this Section, the Service Agreement controls.
7. Acceptable Use
You agree not to:
- Provide false, misleading, or incomplete information
- Use the Sites or services for any unlawful purpose, or in a way that infringes the rights of others, including rights of privacy and publicity

8. Intellectual Property
The Sites and all Content are owned by alphaScaling or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, nonexclusive, nontransferable, revocable license to access and use the Sites for your own lawful purposes. You may not copy, sell, modify, distribute, publicly display, or create derivative works from the Content, or use our name, logo, or marks, without our prior written consent.
Ownership of work product, ad creative, accounts, and data created for a Client is governed by the Service Agreement.
If you send us feedback or suggestions, you give us permission to use them without restriction or payment.
9. Electronic Communications and Text Messages
By using the Sites or giving us your contact information, you agree that we may communicate with you electronically, including by email and through the Sites, and that these communications satisfy any legal requirement that they be in writing.
We send text messages only where you have given consent on one of our forms. Message frequency varies, and message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to receive texts is not a condition of any purchase. See our Privacy Policy for how we handle mobile information.
10. Third-Party Services and Links
Our services rely on third-party platforms and tools, such as advertising networks, customer relationship management and messaging platforms, and scheduling software. The Sites may also link to third-party websites, including Client websites. We do not control these third parties and are not responsible for their performance, availability, content, or policies. A link does not mean we endorse the site. You agree to follow the terms of any third-party service you use in connection with ours, and you access third-party sites at your own risk.
11. Privacy
Our Privacy Policy explains how we collect, use, and share personal information. It is part of these Terms.
12. Disclaimer of Warranties
THE SITES AND OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ALPHASCALING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITES OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT ANY RESULTS OR INFORMATION WILL BE ACCURATE OR RELIABLE, OR THAT THE SITES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NOTHING IN THESE TERMS CREATES A WARRANTY THAT IS NOT EXPRESSLY STATED IN A SERVICE AGREEMENT.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ALPHASCALING AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SITES OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITES OR OUR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID US ANYTHING, OUR TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
These limits apply regardless of the legal theory, whether in contract, tort, negligence, or otherwise. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or willful misconduct.
14. Indemnification
You agree to defend, indemnify, and hold harmless alphaScaling, its affiliates, and their owners, officers, employees, agents, and contractors from any third-party claim, and from the resulting losses, damages, and reasonable attorneys' fees, arising from or related to:
- Your breach of these Terms or any Service Agreement
- Your violation of any law or regulation, including laws governing calls, texts, and emails to Homeowners
- Content, materials, or instructions you provide to us
- Your dealings with any Homeowner, including the work you perform or fail to perform for them
- Your misuse of the Sites or of information obtained through our services
We will give you prompt notice of any claim, and we may control the defense of it at your expense.
15. Termination
We may suspend or terminate your access to the Sites or our services at any time, with or without notice, if you violate these Terms or engage in conduct we consider harmful to us, our Clients, or others. Termination of a Client's services is also governed by the Service Agreement. When access ends, any obligations that have already arisen, including payment obligations, remain in effect. Sections that by their nature should survive termination, including Sections 4, 6, 8, and 12 through 18, survive.
16. Governing Law and Disputes
These Terms, and any claim related to the Sites or our services, are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. You and alphaScaling agree to first try to resolve any dispute informally by contacting each other in writing and negotiating in good faith for at least 30 days. If the dispute is not resolved, you agree that it will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction and venue.
Any claim you bring against alphaScaling must be filed within one (1) year after the claim arose, or it is permanently barred.
17. General Terms
- Entire agreement. These Terms, our Privacy Policy, and any Service Agreement are the entire agreement between you and alphaScaling about their subject matter and replace all earlier understandings. For Clients, if these Terms conflict with a Service Agreement, the Service Agreement controls.
- Severability. If a provision is found invalid or unenforceable, it will be enforced to the extent permitted and the remaining provisions stay in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it or of our right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Events beyond our control. We are not liable for delay or failure caused by events beyond our reasonable control, including outages, advertising platform actions, carrier restrictions, or changes in law.
- Relationship. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
18. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page with a new effective date. If we make material changes, we will also notify Clients by email. Your continued use of the Sites after an update means you accept the updated Terms.
